OFO Collective Pty Ltd ("OFO Collective", "we", "us", or "our") is committed to protecting your privacy and handling your personal information in accordance with the Australian Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and where applicable, the EU General Data Protection Regulation (GDPR).
This Privacy Policy explains what information we collect when you visit ofocollective.com or interact with our services, why we collect it, how we use and share it, and the rights you have over your data.
1. Who we are
The data controller responsible for your personal information is:
- OFO Collective Pty Ltd
- ABN 90 689 232 059
- 405H/521 Toorak Road, Toorak VIC 3142, Australia
- sales@ofocollective.com
2. Information we collect
Information you give us directly
When you fill in a form on our website, submit a lead form through one of our advertisements (for example on Facebook, Instagram, or Google), book a call, or correspond with us by email, we collect the personal information you provide. This typically includes your name, email address, phone number, company name, job title, and the contents of your message. We use the phone number you provide to contact you by phone call, SMS, and WhatsApp — see section 4 below.
Information collected automatically
When you browse ofocollective.com, our hosting and analytics providers automatically collect technical information including your IP address (used to derive approximate geographic region), device type, browser type and version, operating system, the pages you visit, the time and date of your visit, the referring URL, and basic interaction events such as clicks and scroll depth.
Information from third parties
When you book a call via our embedded Google Calendar appointment scheduler, Google shares the booking details you provide with us — your name, email address, the time you selected, and any optional notes. If you reach our site through a paid advertisement, the advertising platform may share limited attribution data with us.
3. How we use your information
We use your personal information to:
- Respond to your enquiries and provide the services you have requested
- Contact you about your enquiry by phone call, SMS, or WhatsApp, as well as by email — see section 4 below
- Schedule and conduct discovery calls
- Send transactional communications relating to a service you have requested
- Send you marketing communications about OFO Collective, where you have opted in or where we have a legitimate interest and you have not objected
- Improve our website, services, and marketing — including by analysing aggregated usage data
- Measure the performance of our advertising and marketing campaigns
- Comply with our legal and regulatory obligations
- Detect, prevent, and respond to fraud, abuse, or security incidents
Under the GDPR, our lawful bases for processing are: (a) performance of a contract with you, or steps taken at your request before entering into a contract; (b) our legitimate interest in operating, securing, and growing our business; (c) your consent, where required (for example, marketing emails); and (d) compliance with a legal obligation.
4. How we contact you after a form submission
When you submit a form through our website or through one of our advertisements (for example a Facebook, Instagram, or Google lead form), you are asking us to get in touch about your enquiry. By submitting your details, you consent to OFO Collective contacting you using the information you provided, including by:
- Phone call — to the phone number you provided
- SMS / text message — to the phone number you provided
- WhatsApp — to the phone number you provided
- Email — to the email address you provided
We use these channels to respond to your enquiry, answer your questions, arrange a call, and follow up about the services you asked about. Message and data rates may apply depending on your mobile plan and provider. Message frequency varies.
You can opt out of any of these channels at any time. Reply STOP to any SMS or WhatsApp message, tell us during a call or in writing, or email sales@ofocollective.com, and we will stop contacting you through that channel. Opting out of marketing or follow-up messages does not affect communications that are strictly necessary to a service you have actively engaged us to provide.
5. Cookies and tracking technologies
Our website uses cookies and similar technologies to analyse traffic, measure marketing performance, and remember your preferences. The third-party services involved are:
- Google Tag Manager and Google Analytics — to load and manage analytics tags and to measure how visitors use the site
- Apollo Website Tracker — to identify the businesses visiting our site so we can tailor our outbound sales process
- Meta Pixel (when active) — to measure the performance of advertising delivered on Facebook and Instagram
- Vercel — our hosting provider, which collects basic, privacy-respecting site analytics
You can disable most cookies through your browser settings or by using browser extensions designed to block tracking. Disabling cookies may affect site functionality.
6. Who we share your information with
We do not sell your personal information.
We share personal information with the following categories of recipients:
- Service providers and processors that help us operate our website and services. These currently include: Vercel (hosting and analytics), Google Workspace (email, calendar, and document storage), Google Tag Manager and Google Analytics, Apollo.io (sales engagement and analytics), HubSpot (customer relationship management), Formspree (contact form processing), our customer messaging and CRM platform (used to send and manage phone, SMS, WhatsApp, and email contact with you), and Meta (advertising measurement, when active).
- Professional advisers, such as lawyers and accountants, where reasonably necessary.
- Government, regulators, or law enforcement, where we are required by law or where disclosure is necessary to establish, exercise, or defend our legal rights.
- A successor entity in the event of a merger, acquisition, or sale of assets — in which case we will notify you of any change in control.
We require all third-party processors to handle your data in accordance with applicable data protection laws and the terms of our agreements with them.
7. International transfers
We are based in Australia. Some of our service providers are based in the United States or other jurisdictions. Where personal data is transferred outside your country of residence, we rely on appropriate safeguards — including standard contractual clauses — to ensure your data remains protected to a standard comparable to that of your home jurisdiction.
8. How long we keep your information
We keep personal information only for as long as is necessary for the purposes for which it was collected:
- Enquiries and contact form submissions: retained for up to 24 months after our last interaction with you, unless you ask us to delete them sooner.
- CRM records of active customers: retained for the duration of our engagement and for a further period of up to 7 years thereafter, in line with Australian record-keeping obligations.
- Analytics data: retained in aggregated, de-identified form indefinitely; identifiable analytics records are typically retained for up to 26 months.
- Marketing subscriber lists: retained until you unsubscribe.
9. Security
We take reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification, or disclosure. These include encryption of data in transit (HTTPS), access controls on our systems, multi-factor authentication on administrative accounts, and the use of reputable third-party providers that follow recognised security standards. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
10. Your rights
Depending on where you live, you may have the following rights in relation to your personal information:
- Access — request a copy of the personal information we hold about you.
- Correction — ask us to correct information that is inaccurate or incomplete.
- Deletion — ask us to delete your personal information, subject to legal exceptions.
- Restriction or objection — ask us to restrict how we use your information, or object to a particular use.
- Portability — receive a copy of your information in a portable, machine-readable format.
- Withdraw consent — where we rely on your consent, you may withdraw it at any time without affecting the lawfulness of processing carried out before that point.
- Unsubscribe — opt out of marketing communications by clicking the unsubscribe link in any of our emails or by emailing us directly.
To exercise any of these rights, email sales@ofocollective.com. We will respond within a reasonable time and in any event within 30 days.
11. Children
Our services are not directed at children under the age of 16, and we do not knowingly collect personal information from children. If you believe we have inadvertently collected information from a child, please contact us so we can delete it.
12. Complaints
If you are unhappy with how we have handled your personal information, please contact us at sales@ofocollective.com in the first instance and we will work with you to resolve the issue.
If you remain unsatisfied, you have the right to lodge a complaint with:
- The Office of the Australian Information Commissioner (OAIC) at oaic.gov.au, if you are in Australia.
- Your local data protection authority, if you are in the European Economic Area or the United Kingdom.
13. Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. The "Last updated" date above indicates when the policy was last revised. Where changes are material, we will highlight them on this page. We encourage you to review this policy periodically.
